Regarding the processing of personal data at the PAN Botanical Garden - Center for the Preservation of Biological Diversity in Powsin

As of May 25, 2018, as the Administrator of your personal data, we are responsible for its use in accordance with Regulation 2016/679 of the European Parliament and of the EU Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (Data Protection Regulation), which aims to unify the rules for the processing of personal data across the EU.

In order to meet the requirements of the new regulations and fulfill the legal obligation imposed by the above-mentioned Regulation, maintaining the principle of transparency, we inform you that:

I Personal Data Administrator:

  • The administrator of your personal data is the Polish Academy of Sciences, Palace of Culture and Science, pl.   • The Administrator has appointed a Data Protection Officer, who can be contacted via email at iod@pan.pl

II. Purpose and basis for use of personal data:

Personal data is obtained as a result of the activities of the Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biological Diversity in Powsin for purposes such as:

  • Implementation of legal obligations, among others, storage of data on electronic/email correspondence, storage of documentation related to the conduct of statutory activities, including educational activities;
  • Issuing invoices and reporting, maintaining accounting records;
  • Keeping records of the settlement of grant applications during the life of the projects and during their sustainability;
  • The exercise of rights of complaint for non-performance or improper performance of the contract;
  • The conclusion and implementation of an agreement between the Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biological Diversity in Powsin and external entities;
  • counteraction and enforcement of claims or receivables, or notification of competent authorities;
  • verification of ability to pay;
  • other legally legitimate activities of the Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biological Diversity in Powsin.

Personal data needed to fulfill legal obligations will be used by the Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biodiversity in Powsin:

  • For the duration of the performance of these duties;
  • For the period of time that regulations mandate that the data be kept;
  • for a period of time during which we may face legal consequences for failing to perform the obligation.

III. Data transfer

The Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biological Diversity in Powsin in the course of its activities provides personal data to the following entities:

  • employees and associates, as well as entities that provide us with consulting and advisory services;
  • Entities providing ICT system management services;
  • entities providing courier and postal services (for the purpose of conducting the necessary correspondence on matters entrusted to us);
  • public authorities authorized to inspect;
  • Personal data will not be transferred outside the European Economic Area;
  • Personal data will not be processed by automated means (including profiling).

IV. Right of access to data

The provisions of the Data Protection Regulation entitle you to make a request to us:

  1. to provide information about the processed data;
  2. issue a copy of the processed data;
  3. Immediate correction of incorrect data;
  4. to complete incomplete personal data, including by providing an additional statement;
  5. Restrict the processing of data in the event of a challenge to its accuracy;
  6. Immediately delete the data unjustifiably processed;
  7. transfer the data to another controller in a commonly used, machine-readable format.

V. Right to object

Against the processing of personal data necessary for the performance of our tasks carried out in the public interest or necessary for the purposes of our legitimate interests - you may object in specific situations. In this case, we will not be allowed to process the personal data unless we demonstrate the existence of compelling legitimate grounds for the processing that override the interests, rights and freedoms of the data subject, or grounds for establishing, asserting or defending claims. On the other hand, if your personal data is processed for direct marketing purposes, you have the right to object to the processing at any time with immediate effect.

VI. The right to file a complaint

If you consider that the processing of personal data carried out by the Polish Academy of Sciences Botanical Garden - Center for the Preservation of Biological Diversity in Powsin is unlawful - you have the right to complain to the President of the Office for Personal Data Protection.
